  2. To place an order, the Customer adds Products to the cart, provides the data needed to fulfil the order (name, delivery address, email address, phone number and, if needed, details for the bill), chooses the delivery method and payment method, reviews the order summary, accepts the Terms of Service and confirms the order using a button labelled with words indicating the obligation to pay (e.g. "Order and pay").

§ 6. Prices

  1. Product prices are given in Polish zloty (PLN) and are final prices. The Seller is not an active VAT payer (subjective exemption under Art. 113(1) of the Polish VAT Act), so prices do not include separately stated VAT.
  2. Prices do not include delivery costs. The delivery cost and the total order price are shown in the cart and during checkout, before the order is placed.
  3. Where the price of a Product is reduced, the Seller shows, next to the reduced price, the lowest price of that Product in the 30 days before the reduction was introduced.
  4. The price binding on the parties is the Product price applicable at the time the order is placed.

§ 7. Payments

  1. The available payment methods are presented during checkout. They may include, among others, BLIK, fast online bank transfers (e.g. Przelewy24), payment cards, Apple Pay and Google Pay.
  2. Payments are handled by external payment operators. The Seller does not store payment card data.
  3. The Customer must pay when placing the order. Order fulfilment starts once the payment is credited. If payment is not made within 3 days of placing the order, the Seller may cancel the order and will inform the Customer.

  1. Delivery is made only within the territory of Poland.
  2. The available delivery methods (InPost parcel lockers and InPost courier) and their costs are presented in the cart and during checkout.
  3. The order is prepared for dispatch within 1–2 Business days of the payment being credited. Delivery usually takes 1–3 Business days from dispatch.
  4. Detailed delivery rules are set out on the "Shipping" page available in the Store.

§ 9. Right of withdrawal

  1. The Consumer may withdraw from the Sales Contract within 14 days without giving any reason and without incurring any costs, except for the costs specified in sections 6 and 7.
  2. The withdrawal period expires 14 days after the day on which the Consumer, or a third party other than the carrier indicated by the Consumer, took possession of the Product. For a contract covering multiple Products delivered separately – from taking possession of the last of them.
  3. To exercise the right of withdrawal, the Consumer submits to the Seller an unequivocal statement of withdrawal, e.g. by email to kontakt@trioamico.pl or by letter to Al. Zjednoczenia 11/37, 01-829 Warszawa, Poland. The Consumer may use the model withdrawal form constituting Annex 2 to the Consumer Rights Act, available on the "Returns, Withdrawal and Complaints" page; however, this is not obligatory. To meet the deadline, it is sufficient to send the statement before it expires.
  4. The Seller will promptly confirm receipt of the withdrawal statement to the Consumer on a durable medium (by email).
  5. The Seller will reimburse the Consumer for all payments made, including the costs of delivering the Product (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days from the day of receiving the withdrawal statement. The refund will be made using the same payment method used by the Consumer, unless the Consumer expressly agrees to a different method that does not involve any costs for them. The Seller may withhold the refund until the Product has been received back or until proof of its return has been supplied, whichever occurs first.
  6. The Consumer must return the Product to the Seller without undue delay and no later than 14 days from the day of withdrawal, to: Al. Zjednoczenia 11/37, 01-829 Warszawa, Poland. To meet the deadline, it is sufficient to send the Product back before it expires. The Consumer bears the direct cost of returning the Product.
  7. The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product.
  8. Pursuant to Article 38 of the Consumer Rights Act, the right of withdrawal does not apply, among others, to contracts:
    • for the supply of goods delivered in a sealed package which cannot be returned after opening for health protection or hygiene reasons, if the package was opened after delivery (this applies in particular to cosmetics, hygiene products and diapers whose factory seal has been broken);
    • for the supply of goods which are liable to deteriorate rapidly or have a short shelf life;
    • for the supply of goods which, after delivery, are by their nature inseparably mixed with other items;
    • for the supply of non-prefabricated goods made to the Consumer's specifications or clearly personalised.

§ 10. Complaints – non-conformity of goods with the contract

  1. The Seller is obliged to deliver a Product that conforms with the contract. The Seller is liable to the Consumer for any lack of conformity of the Product with the contract existing at the time of delivery and becoming apparent within 2 years of that time, under the rules set out in Articles 43a–43g of the Consumer Rights Act. A lack of conformity that becomes apparent within 2 years of delivery is presumed to have existed at the time of delivery. If a shelf-life date is stated on the Product packaging and it expires later than 2 years after delivery, the Seller is liable for a lack of conformity that becomes apparent until that date.
  2. If the Product does not conform with the contract, the Consumer may demand its repair or replacement. The Seller may replace the Product when the Consumer demands repair, or repair it when the Consumer demands replacement, if bringing it into conformity in the manner chosen by the Consumer is impossible or would require excessive costs. The costs of repair or replacement, including in particular delivery costs, are borne by the Seller.
  3. The Consumer may declare a price reduction or withdrawal from the contract if: the Seller has refused to bring the Product into conformity with the contract; the Seller has not brought the Product into conformity with the contract; the lack of conformity persists even though the Seller has tried to bring the Product into conformity; the lack of conformity is so significant that it justifies a price reduction or withdrawal without prior repair or replacement; or it is clear from the Seller's statement or the circumstances that the Seller will not bring the Product into conformity within a reasonable time or without excessive inconvenience to the Consumer. The Consumer may not withdraw from the contract if the lack of conformity is minor.
  4. Complaints may be submitted by email to kontakt@trioamico.pl or in writing to Al. Zjednoczenia 11/37, 01-829 Warszawa, Poland. It is recommended to include: name, contact details, order number, a description of the non-conformity (with photos if possible), the date it was discovered and the Consumer's request. Providing this information makes it easier to handle the complaint but is not a condition for it.
  5. The Seller will respond to the complaint within 14 days of receiving it. Failure to respond within this period means that the complaint is deemed justified.
  6. If the Product needs to be delivered for the complaint to be handled, the Consumer makes it available to the Seller, and the Seller collects it at its own expense.
  7. For Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller's liability under the statutory warranty for defects is excluded to the extent permitted by law.

§ 11. Entrepreneur with consumer rights

The provisions of these Terms of Service concerning the Consumer, in particular regarding the right of withdrawal, complaints about Products not conforming with the contract and prohibited contractual clauses, also apply to an Entrepreneur with consumer rights (Articles 7aa and 38a of the Consumer Rights Act and Article 3855 of the Civil Code). However, an Entrepreneur with consumer rights is not entitled to the assistance of the out-of-court consumer dispute resolution bodies referred to in § 12.

§ 12. Out-of-court complaint handling and redress

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:
    • seek free assistance from a municipal or district consumer ombudsman (rzecznik konsumentów) or a social organisation dealing with consumer protection (e.g. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich);
    • apply to the Voivodeship Inspectorate of Trade Inspection (WIIH) – for the Seller's place of residence, the Masovian Voivodeship Inspectorate of Trade Inspection in Warsaw – to initiate mediation proceedings;
    • apply to the permanent consumer arbitration court operating at the Voivodeship Inspectorate of Trade Inspection.
  2. Information on out-of-court dispute resolution and the register of authorised bodies is available on the website of the Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.
  3. The EU online dispute resolution platform (ODR platform) was closed in July 2025 and is no longer available.
  4. Use of out-of-court dispute resolution is voluntary and requires the consent of both parties.

§ 13. Personal data

The controller of Customers' personal data is the Seller. The rules for processing personal data, including Customers' rights under the GDPR, are set out in the Privacy Policy available in the Store.

§ 14. Product reviews

If Product reviews are published in the Store, the Seller states next to the reviews whether and how it ensures that they come from Customers who have used or purchased the Product.

§ 15. Final provisions

  1. The Seller may amend these Terms of Service for important reasons, in particular changes in the law or changes in payment or delivery methods. Orders placed before the amendment are governed by the Terms of Service in force at the time the order was placed. Customers with an Account will be informed of the amendment at least 14 days in advance.
  2. Matters not regulated in these Terms of Service are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive the Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
  3. Disputes with Consumers are resolved by the courts having jurisdiction under the Code of Civil Procedure. Disputes with Customers who are neither Consumers nor Entrepreneurs with consumer rights are resolved by the court having jurisdiction over the Seller's place of residence.
  4. These Terms of Service are effective from 6 October 2026.
